Energy Transition and Climate Change Act

Transición Energética y Cambio Climático

The Basque Energy Transition and Climate Change Act is in keeping with the spirit of the European Green Deal, pursuing a competitive economy linked to the fair and sustainable development of Basque society. The act builds on the opportunities for implementing the energy transition through a gradual transformation of Basque industry, based on technological/industrial development and decarbonisation.

The law will help ensure that the Basque Country can align with all the regulations, policies and plans to which it has committed which aim to:

  • Drive decarbonisation of the economy, with a view to achieving climate neutrality by 2050, through energy savings and efficiency, use of renewables, electrification of energy consumption and carbon sinks.
  • Achieve a climate-resilient territory, based on effective, coordinated and territorialised actions that prioritise nature-based solutions and ensure a just energy and climate transition that takes account of all vulnerable groups.
  • Improve the competitiveness of the economy in the energy and climate transition, promoting technological and industrial development to provide innovative solutions for achieving both climate neutrality and climate resilience.

Main aims

The act provides a stable legal framework for achieving climate neutrality in the Basque Country by 2050 at the latest, while at the same time increasing the region's climate resilience. The legislation goes further, however, with a commitment to make every effort to bring forward the date for climate neutrality to 2045.

The law also sets other important targets, including:

  • Up to 12% savings in final energy consumption by 2030, and 37% by 2050 (compared to 2021 figures).
  • At least 32% of final energy consumption to be met by renewables by 2030.
  • A 45% cut in emissions by 2030 (compared to 2005).

To ensure that these challenges are met, the law proposes a series of measures, divided into the following chapters:

  • Chapter I. General provisions, object and purposes.
  • Chapter II. Governance, competences and functions of the Basque public administrations regarding energy transition and climate change.
  • Chapter III. Planning instruments for enforcing the objectives of the act.
  • Chapter IV. Regulation on energy transition and other sectoral policies contributing to climate neutrality
  • Chapter V. Measures to ensure the resilience of the Basque territory and society.
  • Chapter VI. Cross-cutting instruments related to energy transition and climate change.
